These are the terms and conditions for the use of Bristol
Museums, Galleries and Archives M Shed website and gallery
information network. These are our terms and conditions for use of
the network, which you may access in several ways, including but
not limited to the World Wide Web and via the kiosks in the M Shed
galleries. These terms and conditions apply whenever you access the
M Shed website mshed.org or the M Shed gallery kiosks on whatever
device.
By using the network, you are deemed to have accepted these
conditions.
By entering your personal details to either the M Shed website
or the gallery kiosks, you will be deemed to have accepted these
terms and conditions. Also, by subscribing to any of our email
services, you are deemed to have accepted these terms and
conditions. Any changes we make to the terms and conditions will be
reflected on the website Terms and Conditions page and updated on
the gallery kiosks.
1. Submission
When you submit your contact details, e-mail address, information
and stories you do so as a personal user of mshed.org or the
gallery kiosk. In most cases we will only publish your story if you
have supplied your name and contact details; however if you do not
supply your name and contact details, we may still publish the
story anonymously. On submission of information or your story, the
data will be held until such time as it may be moderated and
checked for relevance and/or accuracy. If your story is published
on the gallery kiosks and the website, you will be notified via the
e-mail address that you supplied.
We allow you access to the areas of the site or the gallery
kiosks which involves submission of information on the basis
that:
(i) your email address is personal to you and may not be used by
anyone else to access mshed.org
(ii) you do not maliciously create additional registration
accounts for the purpose of abusing the functionality of the site,
or other users; nor do you seek to pass yourself off as another
user
(iii) you comply with these terms and conditions.
If, for any reason, we believe that you have not complied with
these requirements, we may, at our discretion, choose not to
publish and to remove your submission without giving you any
advance notice.
2. Publication
Users of our site may submit material for publication in various
areas of the gallery on gallery kiosks and the website, including
the 'Have Your Say' and 'Tell Your Story' sections.
Interactions with our site are governed by our terms and
conditions. You will be deemed to consent to these guidelines if
you choose to post any content or comments to the website or
gallery kiosk.
When you submit content to us, you do so in accordance with
these Terms of Service.
This means you agree that you have created the content you have
submitted to us, or you have permission from, or are authorised by,
the owner of the content to send it to us.
By submitting content to us, you are granting us an
unconditional, irrevocable, non-exclusive, royalty-free (unless
otherwise agreed with us) worldwide licence to use, publish or
transmit, or to authorise third-parties to use, publish or transmit
your content in any format and on any platform, either now known or
hereinafter invented.
In certain areas of the gallery and the website, content will be
published only at the discretion of the moderator. We, or
authorised third parties, may cut, crop or edit your content at our
or their sole discretion. We may remove your content from use at
any time. Content may appear either on the website or on the
gallery kiosk, or simultaneously in both places. We reserve the
right to select whether the material is suitable for publication.
Content is unlikely to be published on the day of submission and in
some instances may take some time to appear.
We accept no liability in respect of any content submitted by
users and published by us or by authorised third-parties.
You warrant that the material you submit is not obscene,
offensive, defamatory of any person or otherwise illegal; and, you
agree not to post material which is deliberately intended to upset
other users.
Important
You or the owner of the content still own the copyright in the
content sent to us and are free to use the content wherever you or
the owner wish and in whatever media you or the owner want.
We will not publish your email address or personal details and
will comply with Data Protection legislation.
3. Removal of information
If we wish to unpublish, remove or delete your submission to the
'Have Your Say' section, you will not be informed. If we wish to
unpublish, remove or delete your submission to the 'Tell your
Story' section, we will do so by e-mailing you at the address you
have supplied stating that the submission has been removed. If no
contact details are supplied then we reserve the right to publish
or unpublish and delete any submissions made via the website or on
the gallery kiosks. The agreement will terminate and the
information and e-mail address will be deleted.
4. Disclaimer of liability
To the extent permitted at law, we do not accept any
responsibility for any statement in the material. You must not rely
on any statement we have published on mshed.org without first
taking specialist professional advice. Nothing in the material is
provided for any specific purpose or at the request of any
particular person.
For the avoidance of confusion, we will not be liable for any
loss caused as a result of your doing, or not doing, anything as a
result of viewing, reading or listening to the material or any part
of it (except for death or personal injury attributable to our
negligence and to the extent permitted at law).
You can access other sites via links from
mshed.org These sites are not under our control
and we are not responsible in any way for any of their
contents.
We give no warranties of any kind concerning mshed.org or the
material. In particular, we do not warrant that mshed.org or any of
its contents is virus free. You must take your own precautions in
this respect as we accept no responsibility for any infection by
virus or other contamination or by anything which has destructive
properties.
5. Data protection

personal data may be processed.
6. Variations
These terms may be varied from time to time. Please ensure that
you review these terms and conditions regularly as you will be
deemed to have accepted a variation if you continue to use the site
after it has been posted.
7. Force majeure
Although we will do our best to provide constant, uninterrupted
access to mshed.org and to the gallery kiosks we do not guarantee
this. We accept no responsibility or liability for any interruption
or delay.
8. Governing law and jurisdiction
This agreement is governed by English law and the parties agree to
submit to the exclusive jurisdiction of the English courts.
